Service description<\/strong><\/h2>\n\n\n\n<p>Nimbo offers digital tools for <strong>online company valuation<\/strong> and <strong>individual valuations at a fixed price<\/strong>.<br\/>The online valuation provides a <strong>subjective orientation<\/strong> based on user input and market data \u2013 it does <strong>not represent a valuation report, financial or investment advice<\/strong>.<br\/>Deviations between the calculated company value and an actually achievable company value are possible.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>3. No guarantee for availability or delivery time<\/strong><\/h2>\n\n\n\n<p>We endeavor to provide the online company valuation <strong>within approx. 1 hour after payment<\/strong>.<br\/>However, there is <strong>no<\/strong> guaranteed delivery time or permanent system availability. Technical malfunctions, maintenance work or external factors can lead to delays. <\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>4. Models  Prices<\/strong><\/h2>\n\n\n\n<p>We offer the following models (older versions may exist in parallel during the transition):<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>A) Company Subscription<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ongoing access to the valuation of <strong>a single company<\/strong>.<\/li>\n\n\n\n<li>Entries can be adjusted as required during the term.<\/li>\n\n\n\n<li>The <strong>country<\/strong> and the <strong>employee category<\/strong> are fixed with the <strong>first report<\/strong> and <strong>cannot be changed thereafter<\/strong>.<\/li>\n\n\n\n<li>Minimum term: <strong>3 months<\/strong>, then renewable monthly.<\/li>\n\n\n\n<li>Cancellation possible at any time until the end of the current period via the login area at <strong>nimbo.net\/valuation \u2192 Login<\/strong> or by email to <strong><a>support@nimbo.net<\/a><\/strong>.<\/li>\n\n\n\n<li>Nimbo reserves the right to <strong>limit<\/strong> the number of submissions in the event of conspicuously high usage (&gt; 50 valuations\/revisions per month).<\/li>\n\n\n\n<li>Reports may only be ordered to the <strong>email address<\/strong> associated with the account.<\/li>\n\n\n\n<li>No claim for reimbursement of periods already paid.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>b) One-time Purchase<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>One-time payment for a company valuation.<\/li>\n\n\n\n<li>Includes the possibility to revise entries subsequently (<strong>Revision<\/strong>):\n<ul class=\"wp-block-list\">\n<li><strong>Standard:<\/strong> up to 7 days after purchase<\/li>\n\n\n\n<li><strong>Standard Plus:<\/strong> up to 30 days after purchase<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>After the revision window has expired, a new purchase or an upgrade is required.<\/li>\n\n\n\n<li>The <strong>country<\/strong> and the <strong>employee category<\/strong> selected during the first valuation remain fixed.<\/li>\n\n\n\n<li>No claim for reimbursement after the report has been provided.<\/li>\n\n\n\n<li>Support:\n<ul class=\"wp-block-list\">\n<li><strong>Standard:<\/strong> up to 1 hour included<\/li>\n\n\n\n<li><strong>Standard Plus:<\/strong> up to 2 hours included<\/li>\n\n\n\n<li>Additional support: <strong>USD 150 \/ h<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>c) Advisor Packages<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>For professional users (consultants, MA advisors).<\/li>\n\n\n\n<li>Variants:\n<ul class=\"wp-block-list\">\n<li><strong>Regional Abo<\/strong> \u2013 Access limited to the regions\/countries shown on the website at the time of purchase.<\/li>\n\n\n\n<li><strong>Global Abo<\/strong> \u2013 Access without regional restriction.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Minimum term: <strong>3 months<\/strong>, then renewable monthly.<\/li>\n\n\n\n<li>Support: up to <strong>2 hours per month<\/strong> included, beyond that <strong>USD 150 \/ h<\/strong>.<\/li>\n\n\n\n<li>No claim for reimbursement of paid subscription periods.<\/li>\n\n\n\n<li>Prices and currency depend on the country shown at the time of purchase;<br\/>for <strong>CHF<\/strong> invoices, <strong>VAT<\/strong> is charged, but not in other currencies.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>5. Algorithm  Data Changes<\/strong><\/h2>\n\n\n\n<p>Valuation logic, algorithms and market data can change <strong>at any time without notice<\/strong>.<br\/>New reports are automatically based on the current version.<br\/>Nimbo is <strong>not obliged<\/strong> to restore earlier calculations or older valuation bases.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>6. Support<\/strong><\/h2>\n\n\n\n<p>Support is provided by email or telephone.<br\/>See the respective product for support times included in the scope of services.<br\/>An hourly rate of <strong>USD 150 \/ h<\/strong> applies for additional expenses (plus VAT, if applicable).<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>7. Refunds<\/strong><\/h2>\n\n\n\n<p>The following applies in principle:<br\/><strong>Services rendered and paid for will not be refunded.<\/strong><br\/>In exceptional cases, Nimbo may grant refunds after <strong>individual assessment<\/strong> and under <strong>consideration of fairness<\/strong>.<br\/>There is no legal entitlement to this.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>8. Disclaimer of liability<\/strong><\/h2>\n\n\n\n<p>The use of Nimbo services is <strong>at your own risk<\/strong>.<br\/>Nimbo assumes <strong>no liability<\/strong> for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Failures, delays or errors in the calculation, transmission or availability,<\/li>\n\n\n\n<li>direct, indirect or consequential damages, loss of profit, data loss or damage to reputation,<\/li>\n\n\n\n<li>the accuracy or completeness of the valuations.<\/li>\n<\/ul>\n\n\n\n<p>Liability is \u2013 to the extent permitted by law \u2013 <strong>completely excluded<\/strong>.<br\/>In any case, compensation is limited to the amount of the <strong>current subscription period<\/strong> or the <strong>one-time purchases concerned<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>9. Data usage<\/strong><\/h2>\n\n\n\n<p>Entered data can be used in accordance with our data protection regulations to <strong>improve our models and market statistics<\/strong>.<br\/>Nimbo may use the specified email address to send users <strong>product-related information or information on changes<\/strong> (no newsletter advertising).<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>10. Abuse  Blocking<\/strong><\/h2>\n\n\n\n<p>Nimbo can block or terminate accounts at any time in the event of <strong>abuse, manipulation or excessive use<\/strong>.<br\/>There is no entitlement to a refund in such cases.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>11. Individual company valuation at a fixed price<\/strong><\/h2>\n\n\n\n<p>The following provisions also apply to individually commissioned valuations:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>This is <strong>not a valuation report<\/strong>.<\/li>\n\n\n\n<li>The basis is exclusively data provided by the customer, which Nimbo does not check.<\/li>\n\n\n\n<li>The customer must actively participate (data, feedback, appointments).<br\/>If the customer fails to cooperate, Nimbo can terminate the contract after a written reminder.<\/li>\n\n\n\n<li>After the <strong>initial consultation<\/strong>, the customer can cancel <strong>immediately afterwards by email<\/strong> free of charge; once work has begun, a refund is excluded.<\/li>\n\n\n\n<li>Support after completion: up to 3 hours included, then <strong>USD 150 \/ h<\/strong>.<\/li>\n\n\n\n<li>Nimbo may use anonymized excerpts as <strong>examples<\/strong>.<\/li>\n\n\n\n<li>No obligation to provide information to third parties (authorities, counterparties, etc.).<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>12.
